The Right of Way Management section is responsible for the enforcement of Encroachment Violations within the Sacramento County Right of Way in accordance with sections 12.08 and 12.12 of the Sacramento County Code. These sections of the County Code establish penalties for unauthorized activities within the County Right of Way without proper permits.
Per section 12.08 of the County code, performing construction or creating other obstructions within the County right of way without proper permits are subject to fines of up to $2,500 for the first offense increasing for each subsequent fine up to $10,000 per offense. Other violations including the placement of dumpsters, vegetation, signs, etc., left in the road right of way are addressed in County code section 12.12 and are subject to fines in the amount of $200 per violation and increases by an amount of $20 per day for each day beyond an initial 15 day notification of the violation.
